The sale of products on this site is governed by the following general conditions of sale. Please read it carefully.

Definitions

  • Seller: The retailer to whom the sale has been entrusted, clearly indicated in the details of each order.
  • Customer: any natural or legal person who purchases or undertakes to purchase products on this site, including Consumers;
  • Conditions: these general conditions;
  • Order Confirmation: written acceptance of the Customer's order by the site;
  • Consumer: the natural person who purchases or undertakes to purchase Products on this site for purposes unrelated to any business or professional activity carried out;
  • Price: total amount that the Customer will have to pay for the Products;
  • Products: individual goods (including Software) described in documents in current use published on paper and/or on its website, or in the Order Confirmations, which the Customer purchases or agrees to buy.

1. Acceptance of the General Conditions of Sale

The contract stipulated between the Seller and the Customer must be considered concluded with the express acceptance of the order, even if only partial, by the seller. This acceptance is considered tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.

If the Customer is a private individual (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of art. 3 and 4 of Legislative Decree 185/1999 on distance selling.

Any right of the Customer to compensation for damages or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and/or things, caused by the non-acceptance, even partial, of an order.

2. How to purchase

The Customer can only purchase the products present in the seller's electronic catalog at the time the order is placed and which can be viewed online at the address, as described in the relative information sheets. It is understood that the image accompanying the description of a product may not be perfectly representative of its characteristics but may differ in colour, size, accessory products present in the figure. All purchase support information (instructions, informative articles, etc...) are to be understood as simple generic information material. All prices indicated are in accordance with art. 1 paragraph 100 financial law 2008.

Correct receipt of the order is confirmed by the seller by means of an e-mail reply, sent to the e-mail address communicated by the Customer. This confirmation message will contain an "Order Number", to be used in any further communication with the seller. The message re-proposes a part of the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document. In the event of non-acceptance of the order, the seller guarantees timely communication to the customer. For Private Customers, orders are not subject to a minimum order and will be accompanied by the relative receipt which also acts as a receipt.

Given the generally very rapid times for order fulfillment, it is possible to cancel an order only within 24 hours of placing it and only if the order has not already been fulfilled. The order can only be canceled by sending an e-mail to the address, clearly indicating the number of the order to be cancelled, the date of execution of the same and the personal data indicated in the order confirmation e-mail.< /p>

Given the generally very fast times for order fulfillment, it is possible to make changes to an order only in the 24 hours following its execution and only if the order has not already been fulfilled. The order can only be modified by sending an e-mail, clearly indicating the order number to be modified, the date of execution of the same, the personal data indicated in the order confirmation e-mail and the modifications want to make the order itself.

the seller cannot be held responsible in any way for any damage deriving from the failure to cancel or modify the order communicated outside the times and in the ways described above. If the shipped package is refused due to failure to modify or cancel the order, the seller reserves the right to request compensation for the shipping costs incurred, by payment by bank transfer, paypal, credit card or postepay.

In some cases it may be necessary for File System to carry out the corresponding order received on behalf of the customer, on an external site, in full respect of the buyer's privacy. By placing the order, the buyer authorizes File System to do so.

3. Methods of Payment

Payment by advance bank transfer:

In case of payment by advance bank transfer, the order will be managed only after receiving confirmation of the credit from the bank. Payment must be made within 7 days from the date of the order. Go beyond this deadline, the order will be automatically cancelled. The reason for the bank transfer must necessarily include the order number. The availability of the products is to be evaluated only from the time of accreditation.

The data to which to make the transfer will be displayed on the website at the time of order confirmation.

SmartOpen provides payment in cash on delivery mode. By purchasing on delivery, the customer will receive the order directly, which will be paid directly to the courier at the time of delivery.

There is no surcharge for cash on delivery payments. The balance must be paid in cash.

4. Shipping methods and costs

The seller can accept orders for delivery worldwide. For orders placed by private customers, the seller will issue a regular tax receipt which will be attached inside the package containing the ordered goods.

For each order placed by Company customers, Freelancers, the seller issues an invoice for the shipped material which will be attached to the package. The invoice can be found in a special envelope applied to the outside of the package or inside the package itself. We therefore recommend that you check the package carefully if you have not found the invoice. In any case, the Customer may request a copy of the same by sending an e-mail. For the issuance of the invoice, the information provided by the Customer at the time of the order is valid. No change in the invoice will be possible after it has been issued.

No responsibility can be attributed to the seller in the event of a delay in the order or in the delivery of the order. Upon delivery of the goods by the courier, the Customer is required to check:

  • that the number of packages delivered corresponds to what is indicated on the package
  • that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials (adhesive tape or metal strapping).

Any damage to the packaging and/or to the product must be reported immediately, subject to WRITTEN CONTROL SUBJECT to the courier's proof of delivery. In the absence of such writing and once the courier's document has been signed, the Customer will not be able to make any objection regarding the external characteristics of what has been delivered.

Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of the delivery, according to the procedures set out in this document, in chapter 6.

The processing of the order takes place as soon as the payment confirmation is received. Shipping normally takes place within 7-10 working days following receipt of payment. For shipments made by the seller throughout the national territory, delivery normally takes place within 24 working hours from the dispatch of the parcel, with the exception of Sicily, Sardinia and Calabria where delivery normally takes place within 24-48 working hours from the dispatch of the parcel. parcel.

If the courier cannot find anyone at the time of delivery, he will leave a notice on which a telephone number will be reported. By contacting this number you can make arrangements for delivery or for direct collection at the courier's office.

5. Right of withdrawal

The law is on your side. One more reason to buy on this site.

Pursuant to art. 5 DL 185/1999, if the customer is a consumer (i.e. a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form to the seller) , has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the following paragraphs. To exercise this right, the customer must communicate this will within 14 days from the date of receipt of the goods. This communication must be made via email, directly from the contact us page.

Once we have received the aforementioned notice of withdrawal, the Customer Service of this site will quickly inform the customer of the instructions on how to return, assigning a unique RMA code for the return of the goods. The goods must be returned intact, unused, complete with all its parts and in the original packaging (envelopes and boxes), in compliance with the conditions expressed in the following points.

The right of withdrawal is in any case subject to the following conditions:

  • The law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, attached software, etc ...);
  • The purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc...); to limit damage to the original packaging, we recommend, when possible, to place it in a second box. In all cases, the affixing of labels or adhesive tapes directly to the original packaging of the product should be avoided;
  • The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
  • In the event of damage to the goods during transport, the seller will inform the customer of the incident (within the 5th day of receipt of the goods in his warehouses), to allow him to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
  • the seller is not liable in any way for damage or theft/loss of goods returned by uninsured shipments;
  • Upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the original package and/or packaging are damaged, the seller will deduct a percentage from the refund due, in any case not exceeding 10% of the same, as a contribution to the restoration costs.
  • Without prejudice to any repair costs for ascertained damage to the goods, the seller will reimburse the customer for the entire amount already paid, within 14 working days from the date of return shipment of the goods by transferring the amount charged to the Card Credit, via paypal or by bank transfer. In the latter case, the seller will ask the customer to provide the bank details on which to obtain the refund.
  • The right of withdrawal does not apply to audiovisual products or sealed computer software (including those attached to hardware material), once opened. Therefore it is not applicable to commercial software installed by the seller, to the customer who requested it when ordering. In fact, if the customer purchases a tablet or computer with a copy of Microsoft Windows pre-installed as the operating system, the cost of the latter will not be refunded to the customer, as the seller is forced to remove the seals from the software packages to install it on the device.
  • The right of withdrawal is lost entirely, due to lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where the seller ascertains:
  • The use, even partial, of the goods and any consumables;
  • The lack of the original external packaging and/or internal packaging;
  • The absence of integral elements of the product (accessories, cables, manuals, parts, ...);
  • Damage to the product for reasons other than its transport.
  • In the event of forfeiture of the right of withdrawal, the goods will remain at the seller's headquarters, available to the Customer for collection at his expense.

6. Warranty

The products sold are guaranteed, in terms of workmanship and materials, for a period of 24 months, from the date of purchase, with the exception of batteries and accessories (free), delivered together with the products, such as mice, bags, and any other accessories. The batteries are covered by a 6 (six) month warranty from the date of purchase. If the product ceases to function, under conditions of normal and correct use, during the warranty period, the seller will evaluate the opportunity to carry out the repair or replacement of the product. Seller's warranty does not cover failures caused by improper installation, operation, cleaning or maintenance, accidents, damage, misuse or abuse, product alterations not made by seller, defective software, normal wear and tear or any other event, act, default or omission not attributable to the seller. All the components repaired or replaced by the seller will be under warranty for the remaining period of validity of the same or for a period of no less than 3 (three) months.

PIXEL DEFECTIVE LCD PANEL POLICY Despite the highest standards, the complex manufacturing of LCD panels may cause slight imperfections in the display. These imperfections do not compromise the performance of the devices. However, the seller will provide warranty service on the TFT of the devices as follows:

  • Defective light pixel: the guarantee will be applied with the presence of more than 4 light pixels.
  • Dark pixel: the guarantee will be applied if there are more than 5 dark pixels.

The return shipment of the material is charged to the Customer and must be made to the address communicated.

Exclusion from Service under this Limited Warranty

Seller does not warrant uninterrupted or error-free operation of the product. Any support, technical or otherwise, provided for the product under warranty, such as telephone support for operating mode questions and product configuration information, shall be provided without warranty of any kind.

The warranty only covers failures or malfunctions that occur within the warranty period and under normal conditions of use, and the same applies to any defects in materials or workmanship. The Guarantee is not applicable in the following cases:

  1. tampering, repair and/or alteration by unauthorized personnel;
  2. alteration, deletion or removal of the serial number of the products, related components and accessories;
  3. alteration or removal of warranty seals;
  4. damage caused by accident, natural disaster, improper or excessive use - intentional or accidental-, negligence or improper maintenance, or use in abnormal conditions;
  5. damage caused by incorrect installation or connection to a peripheral (printer, optical drive, etc...);
  6. damage caused by an electrical fault or any other external accident;
  7. damage resulting from use that does not comply with the criteria or operating and storage conditions indicated in the User Manual;
  8. damage resulting from the use of spare parts not manufactured or sold by the seller;
  9. damage to/loss of programs, data, or removable storage media, or any costs of recovering such programs or data;
  10. damage resulting from third-party software or computer viruses;
  11. receipt of accessories (free), delivered with the products, such as: mouse, bag, etc...);
  12. The products come with free software pre-installed. In the event of an actual malfunction of this software, the seller will evaluate the opportunity to repair or replace the software itself;
